Free Assessment Terms

1. What is provided

Waypoint AI is currently providing AI workflow assessments at no cost while testing the service model across multiple industries. The assessment includes:

1. (a)A discovery call of approximately 45 to 60 minutes conducted via Google Meet;
2. (b)A written assessment report delivered within 3 business days following the call; and
3. (c)Initial recommendations covering AI tools, automations, and workflow opportunities relevant to your business.

You will not be invoiced for the assessment. No further obligation arises from accepting the assessment.

2. Nature of recommendations

The assessment report contains general guidance based on the information shared during the discovery call. The recommendations are not, and should not be relied upon as:

1. (a)Legal advice;
2. (b)Financial, accounting, or taxation advice;
3. (c)A guarantee of any specific business, financial, or operational outcome; or
4. (d)Advice tailored to specific regulatory, compliance, or industry-specific requirements that have not been disclosed during the call.

Implementation decisions are your sole responsibility. You should consult appropriately qualified professionals before acting on any recommendation that has legal, financial, compliance, or regulatory implications for your business.

3. Call recording and transcription

Discovery calls are recorded and transcribed using Fathom (fathom.video) for the sole purpose of producing your written assessment report. The recording and transcript are also used internally to improve Waypoint AI's processes.

Recordings and transcripts are stored in Fathom's secured servers and in Waypoint AI's controlled-access Google Drive. They are not:

1. (a)Shared with any third party;
2. (b)Used in marketing, case studies, or any public material without your separate written consent;
3. (c)Sold, licensed, or otherwise made available outside Waypoint AI.

If you do not wish the call to be recorded, please advise at or before the start of the call. Waypoint AI will conduct the call using manual notes only. The assessment report timeline may be extended in this case.

4. Privacy and handling of your information

Waypoint AI collects only information you choose to share during the assessment process, together with information you voluntarily provide via the booking and intake forms. Waypoint AI handles personal information in accordance with the Australian Privacy Principles set out in the Privacy Act 1988 (Cth) and the Waypoint AI Privacy Policy available at waypointai.com.au/privacy-policy.

Waypoint AI will not:

1. (a)Sell, lease, or otherwise commercialise your information;
2. (b)Add you to any marketing list without your express consent;
3. (c)Use your business information in case studies, content, or marketing materials without your separate written permission;
4. (d)Disclose your information to any third party other than the sub-processors listed in the Privacy Policy (Fathom, Google Workspace, and Anthropic).

5. Data retention and deletion

You may at any time request deletion of your assessment recording, transcript, written report, and any related notes by emailing ryan@waypointai.com.au. Waypoint AI will:

1. (a)Confirm receipt of your request within 2 business days;
2. (b)Complete deletion within 7 business days of receipt; and
3. (c)Provide written confirmation of deletion.

In the absence of a deletion request, Waypoint AI retains assessment materials for up to 12 months following the assessment date for the purpose of providing follow-up support, and thereafter deletes them in the ordinary course of business.

6. No engagement created

Acceptance of these terms and participation in a free assessment does not create:

1. (a)Any consultant-client relationship beyond the scope described in clause 1;
2. (b)Any obligation on either party to enter into a paid engagement; or
3. (c)Any warranty or guarantee of fitness for purpose, merchantability, or specific result.

If you choose to proceed to a paid engagement under Waypoint AI's Phase 1 (AI Foundations) or Phase 2 (Workflow Automation) services, that work will be governed by a separate, signed engagement agreement that will be provided for your review. These Free Assessment Engagement Terms do not extend to any paid work.

7. Intellectual property

1. (a)Any pre-existing intellectual property of Waypoint AI (including templates, methodologies, prompt frameworks, and reusable analysis structures) used in the production of the assessment report remains the property of Waypoint AI.
2. (b)The written assessment report itself is provided to you for use within your business. You may share it internally, with your professional advisors, and with any party you choose, but may not republish it commercially or claim it as your own work.
3. (c)Information you share during the assessment remains your property. Waypoint AI does not acquire any intellectual property in your business information by conducting the assessment.

8. Limitation of liability

To the maximum extent permitted by law, and without limiting any rights you may have under the Australian Consumer Law:

1. (a)Waypoint AI provides the assessment “as is” without any warranty as to the accuracy, completeness, or suitability of the recommendations for any specific purpose;
2. (b)Waypoint AI is not liable for any loss, damage, or cost arising from your reliance on, or implementation of, any recommendation in the assessment report;
3. (c)Nothing in these terms excludes any guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law.

9. Contact and governing law

These terms are governed by the laws of Tasmania, Australia.
